    Lawyer Martin Kpebu has recently emphasized the need to eliminate the long-standing practice of in-camera hearings in petitions concerning the removal of a sitting Chief Justice. This push for reform is particularly relevant in a time where transparency and accountability in governance are crucial.

    In a televised interview on TV3, Kpebu stated that the secrecy of such hearings creates a barrier to public trust in the judicial system. He remarked, “The in-camera hearing is not good for our democracy at all. We have grown” — highlighting a shift towards a more accountable governance model.

    Kpebu believes that the practice of holding closed hearings is outdated. He noted that when this method was introduced 33 years ago, the context was vastly different. “We’ve evolved and become more refined as a people. We are demanding greater accountability,” he asserted, pointing to the changing expectations of citizens regarding governance.

    Emphasizing the need for public visibility in cases involving high-ranking judicial officials, Kpebu argued, “If a Chief Justice is being held accountable, the public deserves to see and hear the proceedings.” This transparency ensures that judicial officers are aware that any misconduct will not go unnoticed.

    Kpebu drew comparisons with the United States where judicial misconduct cases, particularly involving high-ranking judges, are managed publicly through the legislative process. He stated, “In the US, proceedings involving judges are dealt with in Congress and are open to the public. We must learn from that,” suggesting that Ghana can benefit from adopting similar practices in its judicial processes.

    These calls for reform come amid heightened public discussion regarding a petition for the removal of Ghana’s Chief Justice, Gertrude Sackey Torkornoo. Currently, Article 146(8) of Ghana’s 1992 Constitution mandates that such petitions be heard in-camera, a practice under increasing scrutiny.
